What happens if you stop paying your consortium?

Direct answer: if you stop paying the consortium, you stop competing in the draws and, after the delay set in the contract, you may be excluded from the group. You do not lose everything automatically, but the amounts paid are usually refunded at a discount — administration fee and penalties — and, in most cases, only at the end of the group. That's why selling the share is generally more advantageous than simply dropping out.

What the rule says

The consortium is governed by Law 11.795/2008 and the group's contract. Late installments suspend the right to compete in the draws and, if it continues, lead to the member's exclusion. From then on, you become an excluded/withdrawing participant, entitled to a refund under the contract rules.

How the refund works

  • The refund usually deducts the administration fee and any contractual penalties.
  • The amount is normally paid at the group's closing or by a draw for withdrawers, not immediately.
  • The reserve fund may or may not be refunded, depending on the contract.
  • The exact rules vary by administrator — always check your contract.
Before you stop paying, consider selling the share. If it has already been awarded, the market value is usually far higher than a withdrawer's refund. Even if not awarded, selling may recover more than the discounted refund.
